Dahil doon nakumbinsi diumano silang mag-invest.
“A public prosecutor alone determines the sufficiency of evidence that establishes the probable cause justifying the filing of a criminal information against the respondent because the determination of existence of a probable cause is the function of the public prosecutor.
“Generally, the public prosecutor is afforded a wide latitude of discretion in the conduct of a preliminary investigation.
“A finding of probable cause needs only to rest on evidence showing that there exist a well-founded belief that a crime has been committed and that the respondents is probably guilty thereof.
“WHEREFORE, let an Information for Estafa under paragraph 2 (a) of Art. 315 of the Revised Penal Code as amended by R.A. 10951 be filed against JONATHAN RUBIC DY and MARGARET TAN aka SUNSHINE DIZON before the Regional Trial Court of Daet, Camarines Norte.
